Convert a 457(b) to Gold: Rules & Steps (2026)

To convert a 457(b) to gold, establish whether the sponsor is governmental or a nongovernmental tax-exempt employer. Eligible governmental plan distributions can use IRA rollover routes. Nongovernmental 457(b) distributions cannot be rolled into an IRA; the shared account label does not make their rules interchangeable.

Tax-exempt employer planIRA rollover is not permitted

A non-governmental tax-exempt employer plan does not have the same rollover treatment. An attempted IRA rollover can create an excess contribution.

Governmental indirect rollover60 days; generally 20% withholding

These rules apply to an eligible rollover distribution paid to you. They do not make a non-governmental plan distribution eligible.

2026 general deferral limit$24,500

Governmental catch-ups and special near-retirement catch-ups have separate conditions. Employer and employee deferrals must be considered under the plan’s rules.

Governmental early-withdrawal differenceGenerally no 10% additional tax

Amounts attributable to rollovers into the plan from an IRA or a different plan can be exceptions. A later IRA withdrawal can lose this governmental-plan treatment.

Moving an eligible balance does not make an RMD eligible for rollover. Check plan timing and the receiving IRA’s distribution rules separately.

How it works for this account

  1. Identify the employer and plan category

Ask the administrator for written confirmation of governmental or nongovernmental status. Do not infer eligibility from working for a hospital, university or public-service organization; the sponsor and plan documents determine the category.

  2. Confirm a distributable eligible amount

For a governmental plan, obtain the distribution options and rollover notice. Identify required distributions and other excluded payments before selecting an amount; if the plan is nongovernmental, stop the proposed IRA rollover process.

  3. Separate tax sources and withdrawal needs

Identify pretax, designated Roth and any amounts previously rolled into the plan. Ask how those records affect future withdrawals, especially if access before normal IRA withdrawal age is part of your planning.

  4. Arrange a direct governmental-plan rollover

Confirm the receiving traditional or Roth IRA registration and exact payment instructions. Have the governmental administrator send the eligible amount directly to the trustee, preserving the correct source classification and avoiding personal receipt.

  5. Reconcile the payment before investing

Retain the governmental plan records, check the receiving statement and compare written dealer terms. Confirm custody, permitted bullion, storage and cash availability before authorizing the purchase; eligibility does not establish suitability.

457(b) to gold without penalty

Governmental 457(b) distributions generally avoid the 10% additional early-distribution tax, with exceptions for amounts attributable to rollovers from other account types. After a rollover to a traditional IRA, later withdrawals are governed by IRA exceptions and can lose that treatment. IRS early-distribution exceptions explains the distinction. Avoiding the additional tax never means a taxable pretax withdrawal is free of ordinary income tax.

Account-specific pitfalls to resolve

A nongovernmental plan is the central stop condition: direct payment instructions cannot turn its distribution into an eligible IRA rollover. An allowed transfer between certain deferred-compensation arrangements is not an IRA rollover either. For a governmental plan, retain incoming-rollover source records and do not confuse the plan’s withdrawal treatment with the IRA’s. IRS governmental-plan comparison identifies rollover availability and distribution differences.

What the change adds and what it costs

An eligible governmental rollover may open access to permitted bullion through an IRA custodian. It can also give up useful plan withdrawal treatment and add custody, storage and dealer expenses. Compare keeping a balance available in the governmental plan with moving only an eligible portion. For a nongovernmental participant, a gold IRA application cannot solve the lack of rollover eligibility; obtain a separate explanation of the plan’s payout choices.

457(b) FAQ

Can a nongovernmental 457(b) move to a gold IRA?

No. Nongovernmental 457(b) distributions are not eligible for IRA rollover. A trustee’s willingness to accept money does not establish tax eligibility.

IRS source· as of
Can a governmental 457(b) use a direct rollover?

Yes, for an eligible distribution to a permitted receiving account. Confirm distribution access, tax source and the custodian’s acceptance with the administrator before requesting payment.

IRS source· as of
Will I keep the governmental 457(b) early-tax treatment in an IRA?

No. Later IRA distributions follow IRA rules. Governmental plan treatment generally avoids the additional early tax, subject to exceptions for certain incoming rollover amounts, but it does not carry over automatically.

IRS source· as of
Can Roth 457(b) funds go into a traditional gold IRA?

No. Designated Roth funds require a permitted Roth destination. A governmental pretax balance can move to a traditional IRA or be converted to Roth with separate tax consequences.

IRS source· as of
Does the 60-day rule allow a nongovernmental rollover?

No. The deadline applies only to an eligible rollover payment. Meeting it does not cure an ineligible source account or turn a nongovernmental distribution into an IRA rollover.
